Agreement to Terms

Welcome to The Desexualized Mind. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Member") and Desexualized Mind ("we," "us," "our," or "Company") regarding your purchase and use of The Desexualized Mind program.

By purchasing, accessing, or using our program, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not purchase or use our services.


1. Program Description

What You're Purchasing

The Desexualized Mind is a 30-day digital program designed to help men break free from porn addiction by rewiring thoughts, behaviors, and habits. Your purchase includes:

Core Program:

  • 30 daily video lessons (5-8 minutes each)

  • 30 accompanying PDF guides with daily challenges

  • Access to all content through our Podia platform

Bonus Materials:

  • The Mental Clarity Blueprint (bonus course)

  • The Reset Vault (6 bonus videos for difficult moments)

  • Access to our private Telegram community for peer support

One-Time Payment: $97 (pricing subject to change for new purchases)

What This Program Is NOT

This program is:

  • NOT one-on-one coaching or therapy

  • NOT a substitute for professional mental health treatment

  • NOT guaranteed to work for everyone

  • NOT primarily a community-focused program (the community is a bonus; the daily challenges are the core product)


2. Eligibility and Account Requirements

Age Requirement

You must be at least 18 years of age to purchase and participate in this program. By purchasing, you represent and warrant that you are 18 or older.

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials

  • You are responsible for all activities that occur under your account

  • You must notify us immediately of any unauthorized use of your account

  • We are not liable for any loss or damage arising from your failure to protect your account information

Accurate Information

You agree to provide accurate, current, and complete information during the purchase process and to update such information as necessary.


3. Purchase and Payment Terms

Payment

  • Payment is processed through our third-party payment processor (Stripe, PayPal, or similar)

  • All prices are in USD unless otherwise stated

  • Payment must be received in full before you receive access to the program

  • We reserve the right to change pricing for future purchases at any time

Billing Descriptor

The charge on your credit card or bank statement will appear as DSXLZD or similar.

Failed Payments

If your payment fails or is declined, we reserve the right to immediately suspend or terminate your access to the program.

Taxes

You are responsible for any applicable taxes based on your location. The price you pay may not include such taxes, which may be added at checkout.


4. REFUND POLICY

60-Day Conditional Money-Back Guarantee

We offer a 60-day money-back guarantee for customers who complete the program and do not see results.


ELIGIBILITY REQUIREMENTS

To qualify for a refund, you must:

  1. Complete all 30 days of program content within 60 days of purchase

  2. Provide proof of completion, including:

    • Screenshots of completed progress tracker showing all 30 days checked off

    • Screenshots from platform showing completed modules with completion dates

    • Written summary (300+ words) explaining:

      • Which specific strategies you implemented

      • What results you observed (or did not observe)

      • Why you believe the program did not work for you

  3. Submit refund request within 60 days of purchase date


REFUND PROCESS

  1. Email your refund request to chi@desexualizedmind.com with subject line "Refund Request"

  2. Include all required documentation listed above

  3. Allow 3-5 business days for review

  4. Approved refunds will be processed within 7-10 business days

  5. Upon refund approval, your access to the program will be immediately revoked


DISQUALIFICATIONS

Refunds will NOT be granted if:

  • Program was not completed in full

  • Proof of completion cannot be provided

  • Request is made after 60-day window

  • Evidence suggests fraudulent completion (e.g., all modules completed in single session, generic or incomplete worksheets)

  • Chargeback has been filed (chargebacks void this guarantee)

  • Terms of Service have been violated


IMPORTANT NOTES

  • Completion means genuine engagement with the material, not merely accessing it

  • Simply watching videos without completing action missions does not constitute completion

  • Community access is optional and not grounds for refund

  • We reserve the right to request additional verification

  • We reserve the right to deny refunds that do not meet eligibility requirements


CHARGEBACKS

Filing a chargeback for a product you have received full access to, after agreeing to these terms, may constitute fraud.

If you file a chargeback:

  • This guarantee is immediately voided

  • We will submit evidence to your card issuer showing:

    • You received the product (access logs)

    • You agreed to these terms at purchase

    • Your refund request did not meet stated requirements

  • We reserve the right to pursue legal remedies for breach of contract

  • You may be banned from future purchases


TECHNICAL ISSUES

If you experience technical issues preventing access to the program:

  • Contact support immediately at chi@desexualizedmind.com

  • We will resolve technical issues within 48 hours

  • Refunds for unresolved technical issues (our fault) will be granted at our discretion

  • Technical issues must be reported within 7 days of occurrence


EXCEPTIONAL CIRCUMSTANCES

We may, at our sole discretion, offer refunds outside these terms for:

  • Duplicate purchases made in error

  • Unauthorized purchases

  • Other extraordinary situations evaluated case-by-case

All refund decisions are final and at our sole discretion.

By purchasing, you agree to these refund terms.


5. License and Access

Limited License

Upon payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use The Desexualized Mind program for your personal, non-commercial use only.

Access Period

Your access to the program is perpetual, meaning you have lifetime access to the program content as it exists at the time of your purchase, for as long as we continue to operate the program.

Right to Modify or Discontinue

We reserve the right to:

  • Modify, update, or improve program content at any time

  • Discontinue the program or any portion of it with or without notice

  • Change platform providers or delivery methods

  • Make reasonable changes that do not materially diminish the core value of what you purchased

If we discontinue the program entirely, we will make reasonable efforts to provide you with downloadable copies of the core content where technically feasible.


6. Intellectual Property Rights

Our Ownership

All content in The Desexualized Mind program, including but not limited to:

  • Video lessons and audio content

  • PDF guides and written materials

  • Graphics, images, and design elements

  • The Mental Clarity Blueprint course

  • The Reset Vault videos

  • Website content and structure

  • The "Desexualized Mind" name and branding

...is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

What You Cannot Do

You may NOT:

  • Copy, reproduce, or duplicate any program content

  • Distribute, share, or transmit program materials to others

  • Sell, rent, lease, or sublicense access to the program

  • Publicly display or perform any program content

  • Create derivative works based on program content

  • Remove or alter any copyright, trademark, or proprietary notices

  • Use the content for commercial purposes

  • Share your login credentials with others

  • Record, screenshot, or capture video or written content for distribution

  • Upload program content to file-sharing sites, torrent sites, or public platforms

Enforcement

Violation of these intellectual property terms may result in:

  • Immediate termination of your access without refund

  • Legal action to protect our rights

  • Liability for damages and attorney's fees

Fair Use

You may take personal notes for your own use and may reference general concepts learned from the program in conversations, but you may not reproduce substantial portions of our copyrighted material.


7. Community Guidelines

Telegram Community Rules

Access to our Telegram community is a privilege, not a right. By participating, you agree to:

DO:

  • Treat all members with respect and dignity

  • Maintain confidentiality about what others share

  • Offer support and encouragement

  • Use the appropriate channels for different topics

  • Report violations to us privately

  • Use an anonymous or pseudonymous username to protect your privacy

DO NOT:

  • Share others' personal information or stories outside the group

  • Harass, bully, or attack other members

  • Share pornographic content, explicit images, or triggering material

  • Promote other programs, products, or services without permission

  • Spam the group with irrelevant content

  • Share illegal content or encourage illegal activities

  • Use the community primarily to sell or promote your own business

  • Share program content or materials with non-members

  • Encourage harmful behaviors or self-harm

Privacy Limitations

  • We are not responsible for information you choose to share in the community

  • Other members can see your Telegram username and messages

  • We cannot prevent screenshots or recording by other members

  • Anything shared in the community could potentially become public

  • We strongly recommend not sharing identifying personal information

Enforcement

We reserve the right to:

  • Remove any member from the community at any time for any reason

  • Delete messages that violate these guidelines

  • Provide warnings before removal (but are not obligated to do so)

  • Ban members permanently for serious or repeated violations

Removal from the community does NOT entitle you to a refund.


8. User Conduct and Prohibited Uses

You agree not to use the program to:

  • Violate any laws or regulations

  • Infringe on anyone's intellectual property or privacy rights

  • Transmit viruses, malware, or harmful code

  • Attempt to gain unauthorized access to our systems

  • Interfere with or disrupt the program or servers

  • Impersonate us or another member

  • Collect information about other members without consent

  • Use automated systems (bots, scrapers, etc.) to access the program

  • Reverse engineer, decompile, or disassemble any program components


9. Medical and Professional Disclaimer

Not Medical or Mental Health Treatment

The Desexualized Mind program is for educational and informational purposes only. It is NOT:

  • Medical advice, diagnosis, or treatment

  • Psychotherapy or clinical counseling

  • A substitute for professional mental health care

  • Suitable for everyone with compulsive sexual behaviors

Your Responsibility

By using this program, you acknowledge that:

  • You are solely responsible for your own health and wellbeing

  • You should consult qualified healthcare professionals for medical or mental health concerns

  • Porn addiction may be associated with underlying mental health conditions that require professional treatment

  • This program may not be appropriate if you have serious mental health conditions, trauma, or co-occurring addictions

When to Seek Professional Help

You should seek professional help from a licensed therapist, counselor, or physician if you:

  • Have thoughts of self-harm or suicide

  • Experience severe depression, anxiety, or other mental health symptoms

  • Have trauma or abuse history that requires specialized treatment

  • Find that the program is not sufficient for your needs

  • Have co-occurring addictions or compulsive behaviors

We do not guarantee that the program will:

  • Prevent relapses or setbacks

Your results depend on many factors including your personal circumstances, commitment level, underlying conditions, and individual differences.


10. Testimonials and Results Disclaimer

Any testimonials, success stories, or results shared in our marketing materials or by other members represent individual experiences and outcomes. These are not typical results and should not be interpreted as:

  • A guarantee or promise of results

  • What you should expect to achieve

  • Scientifically verified claims

  • Representative of all users' experiences

Your Results May Vary

Your individual results will depend on many factors including:

  • Your personal circumstances and history

  • The severity of your addiction

  • Your commitment to completing the daily challenges

  • Underlying mental health or medical conditions

  • Your support system and environment

  • Individual biological and psychological differences

Earnings or Lifestyle Claims

If we make any claims about improved quality of life, relationships, productivity, or other benefits, these are not guarantees. Your experience may differ significantly.


11. Limitation of Liability

To the Maximum Extent Permitted by Law:

We are NOT liable for any:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or use

  • Personal injury or emotional distress

  • Relapse or setbacks in recovery

  • Decisions you make based on program content

  • Actions or statements of other community members

  • Technical failures or interruptions in service

  • Loss or corruption of data

  • Unauthorized access to your account

This applies even if we have been advised of the possibility of such damages.

Maximum Liability Cap

Our total liability to you for any claims arising from or related to these Terms or the program shall not exceed the amount you paid for the program ($97).

Your Assumption of Risk

By participating in this program, you acknowledge and assume the risks associated with:

  • Self-directed behavioral change programs

  • Online communities and peer support

  • Digital content and technology limitations

  • The personal nature of addiction recovery


12. Indemnification

You agree to indemnify, defend, and hold harmless The Desexualized Mind, its owner, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use or misuse of the program

  • Your violation of these Terms

  • Your violation of any rights of another person or entity

  • Content you post in the community

  • Your breach of any representations or warranties made herein


13. Third-Party Services

Platform Providers

Our program uses third-party platforms:

  • Podia: For content hosting and delivery

  • Telegram: For community access

  • Payment Processors: For transaction processing

These services have their own terms of service and privacy policies. We are not responsible for:

  • The availability or functionality of these platforms

  • Their privacy practices or data security

  • Changes they make to their services

  • Service interruptions or technical issues on their end

Third-Party Links

Our program or communications may contain links to third-party websites or resources. We:

  • Do not endorse or assume responsibility for any third-party content

  • Are not liable for any damages related to third-party sites

  • Encourage you to review the terms and privacy policies of any third-party sites you visit


14. Termination

Your Right to Terminate

You may stop using the program at any time. Termination does not entitle you to a refund.

Our Right to Terminate

We reserve the right to terminate or suspend your access to the program immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms

  • Violation of Community Guidelines

  • Fraudulent or illegal activity

  • Sharing or distributing program content

  • Abusive behavior toward us or other members

  • Chargeback or payment disputes

  • Any conduct we deem harmful to the program or other members

Effect of Termination

Upon termination:

  • Your license to access the program immediately ceases

  • You must stop using all program materials

  • You must delete any downloaded materials (if any were provided)

  • Any outstanding payment obligations become immediately due

  • Provisions of these Terms that by their nature should survive termination shall survive

Termination does not entitle you to a refund.


15. Modifications to Terms

Our Right to Modify

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of these Terms

  • For material changes, we will provide notice via email or through the program

  • Continued use of the program after changes constitutes acceptance of the new Terms

Your Options

If you do not agree with modified Terms:

  • You may discontinue using the program

  • Contact us to discuss concerns

  • You are not entitled to a refund based on Terms modifications


16. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

Jurisdiction

You agree to submit to the personal and exclusive jurisdiction of the courts located in United Kingdom for resolution of any disputes.

Informal Resolution First

Before filing any formal legal action, you agree to first contact us at chi@desexualizedmind.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute in good faith within 30 days.

Class Action Waiver

You agree to bring any disputes in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative action. Class arbitrations, class actions, and representative actions are not permitted.

Limitation Period

Any claim or cause of action arising from or related to these Terms or the program must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.


17. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the program and supersede all prior or contemporaneous communications, agreements, or understandings.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

Assignment

You may not assign, transfer, or sublicense these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

No Agency

No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms or your use of the program.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, internet failures, or equipment failures.

Survival

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.

Electronic Communications

You consent to receive communications from us electronically, including via email. You agree that all agreements, notices, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

Section headings in these Terms are for convenience only and have no legal or contractual effect.

  3. You agree to be bound by these Terms

  4. You are at least 18 years of age

  5. You understand this is not medical treatment or therapy

  6. You understand all sales are final with no refunds

  7. You accept the risks associated with self-directed recovery programs

  8. You will not share, copy, or distribute program content

  9. You will respect community guidelines and member privacy

  10. You are responsible for your own actions and results

If you do not agree to these Terms, you must not purchase or use our program.

COACHED PROGRAM - ADDITIONAL TERMS


20. COACHED PROGRAM - ADDITIONAL TERMS

The following terms apply specifically to customers who purchase The Desexualized Mind - Coached program. All other sections of these Terms of Service also apply to Coached Program customers.


20.1 COACHED PROGRAM OVERVIEW

The Coached Program includes:

Complete 30-Day Program Content:

  • All content from the Self-Guided Program ($97)

  • 30 daily video lessons

  • 30 action missions with worksheets

  • Complete progress tracking system

  • 6 emergency protocols

  • Access to private Telegram community (optional)

  • Lifetime access to all program content

PLUS Personal Coaching Services:

  • Five (5) one-on-one coaching calls with Chi:

    • Week 1: Foundation Analysis & Trigger Mapping (30 minutes)

    • Week 2: Action Phase Review & Strategy Adjustment (30 minutes)

    • Week 3: Resilience Building & Mental Framework (30 minutes)

    • Week 4: Integration Planning & Long-Term Strategy (30 minutes)

    • Day 45: Follow-Up Integration & Next Steps (45 minutes)

  • Daily accountability check-ins via Telegram or text

  • Personalized trigger analysis document

  • Direct emergency support during waking hours (2-4 hour response time)

  • Custom 90-day maintenance plan document

  • Recorded coaching sessions for your personal reference

20.2 COACHING CALL REQUIREMENTS

SCHEDULING

  • Coaching calls must be scheduled via the provided Calendly links or as otherwise instructed

  • Your first call should be scheduled within 7 days of enrollment

  • Subsequent calls should be scheduled approximately weekly throughout the 30-day program

  • The Day 45 follow-up call should be scheduled for approximately 15 days after completing Day 30

  • All calls are subject to coach availability as shown in the booking system

ATTENDANCE

You must attend all scheduled coaching calls to maintain guarantee eligibility.

Rescheduling:

  • If you must reschedule a call, you must provide at least 24 hours advance notice

  • Rescheduling can be done via the Calendly link or by emailing support

  • We will make reasonable efforts to accommodate rescheduling requests

No-Shows:

  • More than one (1) no-show without 24-hour advance notice will disqualify you from refund eligibility

  • Repeated no-shows (3+ instances) may result in termination of coaching services without refund

  • If you have a legitimate emergency preventing attendance, contact us immediately to explain

CALL FORMAT

  • Calls are conducted via Zoom or Google Meet

  • Video is preferred but not required (audio-only is acceptable)

  • Calls will be recorded for your personal reference only

  • Recordings will be provided to you within 48 hours of each call

  • You are responsible for having a working internet connection and necessary technology

  • You must be in a private space where you can speak openly

RECORDING RESTRICTIONS

  • Call recordings are for your personal use only

  • You may NOT share, distribute, publish, or commercialize recordings in any way

  • You may not record calls separately without explicit permission

  • Violation will result in immediate termination without refund and potential legal action

PROFESSIONAL CONDUCT

Professional and respectful conduct is required during all coaching calls.

We reserve the right to terminate coaching services immediately for:

  • Abusive, threatening, or harassing behavior toward coach or staff

  • Inappropriate sexual conduct or comments

  • Intoxication or impairment during scheduled calls

  • Violation of coach boundaries

  • Any behavior deemed unprofessional, disruptive, or harmful

No refund will be provided if coaching is terminated due to misconduct.


20.3 DAILY ACCOUNTABILITY CHECK-INS

CHECK-IN REQUIREMENTS

  • You are expected to send daily check-in messages via Telegram or text

  • Check-ins should confirm completion of that day's lesson and action mission

  • Check-ins should be sent within 24 hours of completing each day's work

  • Format: Brief message (1-3 sentences) confirming progress

Example: "Day 12 complete. Action mission done. Urges at 3/10 today."

RESPONSE TIME

  • We will respond to check-ins within 24 hours (typically much faster)

  • Responses will include acknowledgment, encouragement, or brief guidance as needed

  • Check-ins are brief accountability touchpoints, not full coaching sessions

  • Questions requiring extended discussion should be saved for scheduled coaching calls or emergency support

CONSISTENCY REQUIREMENTS

  • Regular check-ins are required to maintain guarantee eligibility

  • Missing 7+ consecutive days of check-ins without communication may disqualify you from refund eligibility

  • If you need to pause check-ins for legitimate reasons (travel, emergency, illness), communicate this in advance

  • We understand life happens—proactive communication is key

FAILURE TO ENGAGE

  • Consistent failure to respond to check-ins (14+ consecutive days without explanation) may result in termination of coaching services without refund


20.4 EMERGENCY SUPPORT

AVAILABILITY

  • Emergency support is available via Telegram or text for urgent situations when relapse is imminent

  • Response time: 2-4 hours during waking hours (typically faster)

  • Waking hours: Approximately 8am-10pm UK, 7 days per week

  • This is NOT 24/7 support

  • Responses may include voice messages, text guidance, or brief calls as appropriate to the situation

APPROPRIATE USE

Emergency support is for genuine crisis moments only:

  • Intense urges despite using emergency protocols from the program

  • You are about to relapse and need immediate intervention

  • Unexpected high-risk trigger situation you weren't prepared for

  • Crisis moment that cannot wait until your next scheduled coaching call

INAPPROPRIATE USE

Emergency support is NOT for:

  • General questions about the program (use daily check-ins)

  • Scheduling or administrative matters (email support)

  • Non-urgent program questions (save for coaching calls)

  • Requests for additional coaching outside scheduled calls

BOUNDARIES

  • Emergency support is guidance and accountability, not extended coaching sessions

  • Repeated misuse of emergency support for non-urgent matters may result in:

    • Warning and clarification of appropriate use

    • Restriction of emergency support access

    • Termination of coaching services without refund (in extreme cases)

  • We will communicate clearly before restricting access

CRISIS DISCLAIMER

Emergency support is NOT crisis intervention or mental health treatment.

If you are experiencing mental health crisis, suicidal thoughts, or are in immediate danger:

  • Call 911 for emergencies

  • Call 988 (Suicide & Crisis Lifeline)

  • Contact a licensed mental health professional immediately

  • Go to your nearest emergency room

Our emergency support cannot and does not replace professional crisis services. We are not equipped to handle mental health emergencies.


20.5 DELIVERABLES

PERSONALIZED TRIGGER MAP

  • Created during or shortly after your Week 1 coaching call

  • Delivered as a written document within 48 hours of Week 1 call

  • Outlines your specific vulnerability patterns, triggers, and customized strategies

  • For your personal use only (may not be shared or distributed)

90-DAY MAINTENANCE PLAN

  • Created during or shortly after your Week 4 coaching call

  • Delivered as a written document within 48 hours of Week 4 call

  • Outlines your personalized strategy for Days 31-120

  • Includes protocols for high-risk situations, ongoing habits to maintain, and early warning signs

  • For your personal use only (may not be shared or distributed)

CALL RECORDINGS

  • All coaching calls are recorded with your knowledge

  • Recordings provided to you within 48 hours of each call

  • Recordings are for your personal reference only

  • You may NOT share, distribute, publish, or commercialize recordings in any way

  • Violation will result in immediate termination without refund and potential legal action


20.6 COACHED PROGRAM REFUND POLICY

The 60-day money-back guarantee (Section 4) applies to the Coached Program with additional requirements beyond the standard program guarantee.

ELIGIBILITY REQUIREMENTS

To qualify for a refund, you MUST:

1. Complete all 30 days of program content

  • All video lessons watched

  • All action missions completed with worksheets

2. Attend all five (5) coaching calls:

  • Week 1 call

  • Week 2 call

  • Week 3 call

  • Week 4 call

  • Day 45 follow-up call

OR provide documentation of legitimate inability to attend (medical emergency, family crisis, etc.) AND make good-faith effort to reschedule

3. Respond to daily accountability check-ins regularly:

  • Missing no more than 7 consecutive days without communication

  • Demonstrate consistent engagement with the check-in process

4. Provide proof of completion, including:

REFUND PROCESS

  1. Submit refund request with all required documentation

  2. Allow 5-7 business days for review

  3. We may request additional information or clarification

  4. Approved refunds will be processed within 10 business days

  5. Refunds will be issued to the original payment method

  6. Upon refund approval:

    • All program access will be immediately revoked

    • All deliverables (Trigger Map, Maintenance Plan, call recordings) must be deleted from your possession

    • You must confirm deletion in writing

REFUNDS WILL NOT BE GRANTED IF:

  • Program content was not completed in full

  • Coaching calls were not attended (more than one no-show without 24-hour notice, or failure to make good-faith effort to reschedule missed calls)

  • Daily check-ins were not responded to regularly (7+ consecutive days missed without communication, or pattern of inconsistent engagement)

  • Proof of completion cannot be provided or is insufficient

  • Evidence suggests fraudulent completion (e.g., all modules completed in single session, obviously rushed worksheets, generic summaries that don't reflect coaching discussions, contradiction between claimed completion and coach observations)

  • Request is made after 60-day window from purchase date

  • A chargeback has been filed (chargebacks void this guarantee)

  • Terms of Service have been violated (misconduct, sharing materials, etc.)

  • You were terminated from the program for policy violations

  • You did not engage in good faith with the coaching process

COACHING ENGAGEMENT REQUIREMENT

"Attending" coaching calls means genuine participation, not merely being present.

Refunds may be denied if:

  • You were consistently uncommunicative during calls

  • You refused to answer questions or engage with the coaching process

  • You did not implement strategies discussed in coaching

  • Coach notes indicate lack of good-faith engagement

  • You repeatedly arrived late or left early from calls without valid reason

The coaching component requires active, honest, good-faith participation. Simply showing up without engaging does not fulfill the requirement.


20.7 CAPACITY AND AVAILABILITY

MONTHLY CAPACITY LIMITS

  • The Coached Program is limited to 10 active clients per month

  • This ensures quality support and prevents coach overwhelm

  • When capacity is reached, enrollment will be closed

  • You may join a waitlist for the following month

  • Capacity is calculated on a rolling basis (not strict calendar month)

SCHEDULING LIMITATIONS

  • Coaching calls are subject to coach availability

  • Available time slots are shown in the Calendly booking system

  • If you cannot find a suitable time, contact support for alternatives

  • We will make reasonable efforts to accommodate scheduling needs across time zones

  • However, we cannot guarantee specific days or times will be available

PROGRAM MODIFICATIONS

  • We reserve the right to modify coaching availability or format with reasonable advance notice

  • Changes will not affect customers already enrolled in the Coached Program

  • If we must discontinue coaching services entirely, enrolled customers will either:

    • Complete their coaching as originally agreed, OR

    • Receive a prorated refund for unused coaching services


20.8 PRIVACY AND CONFIDENTIALITY

YOUR PRIVACY

  • All coaching conversations are confidential

  • Information shared during calls or check-ins will not be disclosed to third parties except:

    • As required by law

    • If you pose an imminent danger to yourself or others

    • With your explicit written permission

  • We do not sell or share your personal information

  • Call recordings are stored securely and are accessible only to you and necessary staff

YOUR RESPONSIBILITIES

  • You may not record coaching sessions separately without explicit permission

  • You may not share details of coaching conversations publicly in a way that identifies the coach

  • You may not use the coach's real name or identifying information in public forums, social media, or reviews without permission

  • Testimonials may be provided with your permission, following agreed-upon guidelines for anonymity

ANONYMIZED USE

  • We may use anonymized, de-identified information from coaching experiences to improve the program

  • No personally identifying information will be used without your explicit consent

  • You may request that your information not be used even in anonymized form


20.9 COACHING RELATIONSHIP AND BOUNDARIES

NATURE OF RELATIONSHIP

The coaching relationship is:

  • Educational and supportive in nature

  • Focused on accountability and strategy implementation

  • NOT a therapeutic or clinical relationship

  • NOT licensed mental health counseling

  • NOT medical advice or treatment

  • NOT a substitute for professional therapy

This is coaching, not therapy. We do not diagnose, treat, or provide clinical mental health services.

COACH'S ROLE

The coach will:

  • Provide guidance based on the program methodology

  • Hold you accountable to your stated commitments

  • Help you troubleshoot challenges and obstacles

  • Offer support during difficult moments

  • Celebrate your progress and wins

  • Adjust strategies based on what's working for you

The coach will NOT:

  • Provide therapy or clinical treatment

  • Diagnose mental health conditions

  • Prescribe medications or medical interventions

  • Act as a crisis counselor

  • Be available 24/7

  • Make decisions for you

  • Guarantee specific outcomes or results

BOUNDARIES

  • All communication should remain professional at all times

  • Personal relationships outside of coaching context are not appropriate

  • Coaching is limited to the scope defined in this agreement

  • The coach reserves the right to establish and enforce reasonable boundaries

  • Violation of boundaries may result in termination of coaching services without refund

DUAL RELATIONSHIPS

  • If you have a pre-existing relationship with the coach outside of this program, you must disclose this during the intake process

  • We reserve the right to decline coaching services if a conflict of interest exists


20.10 LIMITATIONS AND DISCLAIMERS SPECIFIC TO COACHING

NO GUARANTEED RESULTS

  • While coaching provides additional support and accountability, we cannot and do not guarantee specific results

  • Your success depends primarily on your own effort, commitment, and consistent application of strategies

  • Coaching enhances the program experience but does not replace personal responsibility for your recovery

  • Individual results vary based on many factors outside our control

COACH AVAILABILITY

We will make reasonable efforts to maintain consistent availability. However, the coach may occasionally be unavailable due to:

  • Illness or personal emergency

  • Previously scheduled time off or vacation

  • Technical difficulties

  • Other unforeseen circumstances

In such cases, we will:

  • Notify you as soon as reasonably possible

  • Reschedule missed calls promptly

  • Extend your coaching period if necessary to accommodate rescheduled calls

  • Provide alternative support if available

TECHNICAL ISSUES

  • Coaching is delivered via internet-based platforms (Zoom, Telegram, etc.)

  • You are responsible for having a working internet connection, necessary technology, and a private space for calls

  • We are not responsible for technical issues on your end (poor internet, device problems, etc.)

  • If technical issues on our end prevent a scheduled call:

    • The call will be rescheduled at no additional charge

    • Reasonable accommodations will be made

    • This will not count as a no-show on your part

INDEPENDENT CONTRACTOR

The coach operates as an independent contractor, not an employee. The coaching relationship does not create an employment, partnership, agency, or joint venture relationship.


20.11 TERMINATION OF COACHING SERVICES

WE MAY TERMINATE YOUR COACHING SERVICES IMMEDIATELY FOR:

  • Violation of these Terms of Service

  • Abusive, threatening, or harassing behavior toward coach or staff

  • Repeated no-shows without communication (3+ instances)

  • Consistent failure to engage with the program or coaching process in good faith

  • Sharing or distributing program materials, recordings, or deliverables

  • Fraudulent activity or misrepresentation

  • Failure to respond to check-ins for 14+ consecutive days without explanation

  • Any conduct we deem inappropriate, harmful, or disruptive

CONSEQUENCES OF TERMINATION

If we terminate your coaching services for cause:

  • No refund will be provided

  • All program access will be immediately revoked

  • All deliverables (Trigger Map, Maintenance Plan, recordings) must be deleted from your possession

  • Outstanding coaching calls will be forfeited

  • You may be permanently banned from future purchases

YOU MAY TERMINATE COACHING SERVICES

You may request cancellation by emailing support.

If you voluntarily terminate before completing the program:

  • No refund will be provided (you received access and began receiving coaching services)

  • Program access to content remains (lifetime access to self-guided materials)

  • All remaining coaching calls are forfeited

  • This does not qualify for the money-back guarantee


20.12 DISPUTE RESOLUTION FOR COACHING MATTERS

If you have concerns or disputes regarding coaching services:

STEP 1: Direct Communication

  • Contact us directly at chi@desexualizedmind.com

  • Explain your concern clearly and specifically

  • Provide specific examples if applicable

  • Allow us 3-5 business days to respond

  • Most issues can be resolved through direct, good-faith communication

STEP 2: Management Review If direct communication does not resolve the issue:

  • Request review by senior management

  • Provide detailed written explanation of your concern

  • Include any relevant documentation (while respecting confidentiality)

  • Allow 7-10 business days for review and response

STEP 3: Formal Dispute Resolution If the issue remains unresolved:

  • Standard dispute resolution provisions in Section 16 of these Terms apply

  • You retain all rights under the 60-day guarantee (if you meet eligibility requirements)

GOOD FAITH REQUIREMENT

Both parties agree to engage in good faith efforts to resolve disputes before pursuing formal dispute resolution or legal action.


20.13 INTEGRATION WITH OTHER TERMS

All other sections of these Terms of Service apply to Coached Program customers, including but not limited to:

  • Section 1: Program Description

  • Section 5: License and Access

  • Section 6: Intellectual Property Rights

  • Section 7: Community Guidelines

  • Section 9: Medical and Professional Disclaimer

  • Section 10: Testimonials and Results Disclaimer

  • Section 11: Limitation of Liability

  • Section 12: Indemnification

  • Section 16: Governing Law and Dispute Resolution

In the event of conflict between this Coached Program section (Section 20) and other sections, the terms in this Coached Program section control for matters specifically related to coaching services.


20.14 ACKNOWLEDGMENT - COACHED PROGRAM

By purchasing the Coached Program, you acknowledge and agree that:

  • You have read and understood these coaching-specific terms in addition to the standard Terms of Service

  • You agree to attend all scheduled coaching calls or reschedule with proper notice

  • You agree to participate in daily accountability check-ins regularly

  • You understand the boundaries and limitations of the coaching relationship

  • You understand this is educational coaching, not therapy or medical treatment

  • You understand the requirements for refund eligibility under the Coached Program

  • You commit to engaging in good faith with the coaching process, including:

    • Active participation in coaching calls

    • Honest communication about your progress and challenges

    • Implementation of strategies discussed in coaching

    • Consistent engagement with check-ins

  • You understand that coaching success depends primarily on your own effort, commitment, and consistent application of the program

  • You accept personal responsibility for your recovery outcomes
